Terms of Service - AJA RETRO Portal

1. Proprietary Rights and License Model

Intellectual Property Ownership: AJA RETRO retains absolute ownership, copyright, and intellectual property rights over the raw source code, compiled binaries, algorithms, bytecode manipulation methodologies, and associated web dashboard interfaces.
Source-Available Grant: The raw source code is made accessible to licensees solely for the purposes of transparency, security auditing, validation of integrity, and compilation for personal use.
Strict Limitations: Access to the source code does not constitute an open-source grant. You are strictly prohibited from forking, adapting, modifying, copying, merging, publishing, distributing, sub-licensing, or selling the Software or any derivative works without explicit, written, prior authorization from AJA RETRO. Unauthorized distribution will result in immediate license termination and legal action under applicable copyright laws.

2. Commercial Subscription and Active Node Telemetry

License Tiers: Commercial licenses are assigned per monthly or annual billing cycle based on the number of active server instances or designated IP addresses.
Automated Integrity Checks: The Software incorporates an early-bootstrap JVM cryptographic integrity check. Upon initialization, the Software establishes an outbound connection to our central Virtual Private Server (VPS) validation network to confirm the validity of the license or host IP address.
Service Interruptions: If the licensing backend detects an invalid, expired, blacklisted, or manipulated license state, the security features or update pipelines may be dynamically suspended. AJA RETRO is not responsible for server operational disruption caused by failed authorization checks resulting from user non-payment or license abuse.

3. Acceptable Use Policy

You agree to use the Software strictly for lawful administrative and security optimization purposes within your Minecraft server environments. You may not use the Software to deliberately exploit third-party environments, disrupt remote infrastructure, bypass upstream hosting network protocols, or violate the acceptable use policies of your primary infrastructure providers.

4. Disclaimer of Warranties and Limitation of Liability

The Software is provided on an "as-is" and "as-available" basis. While the Software implements advanced JVM-level sandboxing, runtime heuristics, and security mitigations, AJA RETRO does not guarantee that the software is completely immune to future zero-day vulnerabilities, specialized native-code injection techniques, or physical server infrastructure security breaches.

To the maximum extent permitted by applicable law, AJA RETRO shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of player data, server downtime, financial losses from store chargebacks, hardware blacklisting by upstream providers, or operational instability arising out of the use or inability to use the Software.

5. Maximum Aggregate Monetary Liability Cap

In the event that AJA RETRO is found liable for any loss, claim, or damage under any legal theory (whether in contract, tort, negligence, strict liability, or otherwise), AJA RETRO's total aggregate liability to you or any third party shall strictly be capped at and limited to the total monetary amount actually paid by you to AJA RETRO for the specific Software subscription during the six (6) month period immediately preceding the event giving rise to the claim, or $50.00 USD, whichever is less.

6. Binding Individual Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT WAIVES YOUR RIGHT TO A JURY TRIAL AND CLASS ACTION LAWSUITS.

Individual Resolution: You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Software, or your license subscription shall be resolved exclusively through final and binding individual arbitration, rather than in court.
Class Action Waiver: YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

7. User Indemnification

You agree to defend, indemnify, and hold harmless AJA RETRO, its developers, operators, and affiliates from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your server configuration, un-whitelisted third-party plugins, user-generated content, or violation of these Terms.
